Terms of Service

Welcome to ROEM. These Terms of Service ("Terms") are a binding agreement between you and Lucrative Merchants LLC ("ROEM," "we," "us"). By using ROEM, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the service.

1. Eligibility

You must be at least 18 years old to use ROEM, and at least the legal drinking age in your location to use features related to alcohol. By using ROEM, you confirm you meet these requirements and that the information you provide is accurate.

2. Your account

You're responsible for your account and for keeping your login secure. You agree to provide accurate information and to notify us of any unauthorized use. You may not share your account or let others use it.

3. Membership, billing & cancellation

Browsing ROEM is free. A paid Membership unlocks features such as Crews and the full Mischief concierge.

• Pricing. Membership is offered at the rates shown at checkout (currently founder pricing of $1/month or $10/year). Founder pricing is locked for the life of your continuous subscription — if we raise prices for new members, your rate won't change as long as your subscription stays active.
• Auto-renewal. Memberships renew automatically at the end of each billing period (monthly or yearly) until you cancel. By subscribing, you authorize us and our payment processor to charge your payment method on each renewal.
• Cancellation. You can cancel anytime through the billing portal in the app. Your membership remains active until the end of the current billing period, after which it won't renew.
• Refunds. Except where required by law, payments are non-refundable, and we don't provide refunds or credits for partial periods. If you believe you were charged in error, contact us at support@roem.app.
• Taxes & changes. Prices may include applicable taxes. We may change Membership features or pricing on a going-forward basis with notice; changes won't affect the founder rate of an active subscription.
• App store purchases. If you purchase through the Apple App Store or Google Play, billing, renewals, and refunds are handled by that store under its terms.

4. Your content

You may post content such as reviews, ratings, crew names, and messages ("Your Content"). You keep ownership of Your Content. You grant ROEM a worldwide, non-exclusive, royalty-free license to host, display, and use Your Content to operate and improve the service. You're responsible for Your Content and confirm you have the rights to post it. We may remove content that violates these Terms or that we consider harmful, and we may do so without notice.

5. Acceptable use

You agree not to: break the law or others' rights; post false, abusive, harassing, hateful, or infringing content; spam or scrape; attempt to access accounts or systems without authorization; interfere with the service; or misuse Crews to harass others. We may suspend or terminate accounts that violate these Terms.

6. Venue information & recommendations

ROEM is a discovery and planning service. We don't own or operate the venues we list, and we're not responsible for their products, services, hours, pricing, availability, or conduct. Information (including venue details, scores, and AI-generated suggestions from Mischief) is provided for convenience and may be inaccurate or out of date. Always confirm details directly with the venue, follow all laws, verify age requirements, and drink responsibly.

7. Intellectual property

The ROEM name, logo, design, software, and content (excluding Your Content and third-party content) are owned by Lucrative Merchants LLC and protected by law. We grant you a limited, personal, non-transferable license to use ROEM for its intended purpose. You may not copy, modify, distribute, or reverse-engineer the service except as allowed by law.

8. Disclaimers

ROEM is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted, error-free, or that recommendations will meet your expectations.

9. Limitation of liability

To the fullest extent permitted by law, Lucrative Merchants LLC and its owners and partners won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of ROEM. Our total liability for any claim relating to the service won't exceed the greater of the amount you paid us in the 12 months before the claim or US $50.

10. Indemnification

You agree to indemnify and hold harmless Lucrative Merchants LLC from claims, damages, and expenses (including reasonable legal fees) arising from your use of ROEM, Your Content, or your violation of these Terms or the law.

11. Termination

You may stop using ROEM and delete your account at any time (see Account & Data Deletion). We may suspend or terminate your access if you violate these Terms or to protect the service or other users. Sections that by their nature should survive termination will survive.

12. Governing law & disputes

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-laws rules. Before filing any claim, you agree to first contact us at support@roem.app so we can try to resolve it. Any dispute not resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Washington, unless otherwise required by applicable consumer-protection law.

13. Apple App Store

If you use ROEM on an Apple device: these Terms are between you and Lucrative Merchants LLC only, not Apple; Apple has no obligation to provide support or handle claims relating to the app; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You confirm you're not located in a U.S.-embargoed country or on a prohibited-parties list, and you agree to comply with applicable app-store and export rules.

14. Changes to these Terms

We may update these Terms from time to time. We'll post the updated version here with a new "Last updated" date. Your continued use after changes take effect means you accept the updated Terms.
